Florida Payer Recoupment for Therapists: 5 Easy Essentials
Florida payer recoupment for therapists is what happens when an insurer or health maintenance organization (HMO) decides it overpaid a claim and asks for the money back, often by holding it out of later payments. Florida law puts time limits on how far back a payer can look, and the limit depends on your license type. This guide shows the limits, the gap for counselors and social workers, and what to do when a notice arrives.
What Florida payer recoupment for therapists means
An overpayment is a payment above what the payer owed under your contract, such as an amount over the allowed amount or a payment on a claim the payer later says was ineligible. Florida sets the look-back windows in section 627.6131 for health insurers and section 641.3155 for HMOs. Both are 2026 texts. The adjustment shows up on your remittance, so read it with our guides to remittance advice and CARC and RARC codes.

The five limits behind Florida payer recoupment for therapists
These are the windows the 2026 statutes set. They apply to commercial insurers and HMOs, not to fraud findings, which the statutes exclude for providers convicted under section 817.234.
| Rule | Limit | Who it covers |
|---|---|---|
| 1. Overpayment claim after a non-fraud audit or retroactive review | 30 months after payment | General rule for providers |
| 2. Overpayment claim, shorter window | 12 months after payment | Providers licensed under chapters 458, 459, 460, 461, 466 or 490 |
| 3. Underpayment claim by the provider | 12 months after the payer’s payment | Providers under chapters 458, 459, 460, 461 or 466 |
| 4. Retroactive denial because the subscriber was ineligible | 1 year after payment | HMOs (section 641.3155) |
| 5. Your written contest of an insurer’s overpayment claim | 35 days | Insurer statute (section 627.6131) |
The HMO statute sets its own response period for an overpayment claim, which reads as 40 days in the 2026 text. Put the date on the calendar the day the notice arrives.
Which license gets which window?
Chapter 490 covers psychologists and chapter 491 covers clinical social workers, marriage and family therapists and mental health counselors. Psychologists appear in the 12-month overpayment list, and psychiatrists appear through the medical chapters 458 and 459. Chapter 491 is not named in either 12-month list, so the text reads as leaving those clinicians under the general 30-month overpayment window. The underpayment list names chapters 458, 459, 460, 461 and 466, but not 490 or 491. Florida payer recoupment for therapists is not one-size-fits-all. Ask counsel how a payer’s contract and these statutes apply to your license before you rely on any single number.
Private payers, Medicare and Medicaid, and state rules
Private payers
Commercial contracts add their own audit and recoupment language, so read yours with our guide to payer contract compliance. Florida payer recoupment for therapists is limited by the statutes above, but your contract may add notice steps and appeal rights.
Medicare and Medicaid
Medicare and Medicaid recoveries follow federal rules, state Medicaid rules and the plan’s contract, not the commercial windows in this table. Take any Medicare or Medicaid recovery letter to your counsel or compliance officer.
State rules
The Florida Department of Financial Services says on its medical provider page that it reviews prompt pay complaints, and that payment or amount disputes under section 408.7057 go to the claim dispute program run by the Agency for Health Care Administration. These Florida payer recoupment for therapists windows belong to Florida. Do not apply them to Georgia or Texas payers.
How far back can a Florida insurer take back a payment?
For a non-fraud audit or retroactive review, the general window is 30 months after payment. For providers licensed under the listed medical, dental and psychology chapters, it is 12 months. An HMO also cannot deny a paid claim for subscriber ineligibility more than one year after paying it. Florida payer recoupment for therapists therefore turns on your license chapter and on the date of the payment, not the date of the service.
What to do Monday morning
- Pull the last 12 months of remittances and flag every negative adjustment or offset, to size your Florida payer recoupment for therapists exposure.
- For each recoupment notice, write the payment date, the notice date and your 35-day contest date.
- Gather the chart note, claim and eligibility proof for each claim the payer wants back.
- Send your contest in writing and keep proof of delivery.
- Log underpayments as you find them so you can dispute within 12 months; see our guide to underpayments.
- Use our insurance companies contact directory to reach the right department, and keep a cash flow buffer for a surprise offset.
The short version: Florida payer recoupment for therapists
Florida payer recoupment for therapists is bounded by 30 months for most overpayment claims and 12 months for the listed license chapters. Contest in writing within the statutory window, keep proof, and ask counsel how chapter 490 and 491 licenses fit.

FAQ
How long can a Florida insurer wait before asking for an overpayment back?
For a non-fraud audit or retroactive review, the 2026 insurer and HMO statutes say 30 months after payment in general, and 12 months for providers licensed under the listed chapters. Chapter 491 licenses are not on the 12-month list in the statute text.
Does the 12-month limit apply to psychologists and counselors?
Psychologists (chapter 490) are named in the 12-month overpayment list. Clinical social workers, marriage and family therapists and mental health counselors (chapter 491) are not named in the text. Ask counsel how the statute applies to your license.
How long do I have to dispute an underpayment?
For the providers the statutes name, an underpayment claim must go in within 12 months after the payer’s payment. The named chapters are the medical ones, so log and dispute your underpayments within 12 months anyway.
Where do I send a payment dispute about a Florida plan?
The Florida Department of Financial Services reviews prompt pay complaints for plans under its authority, and payment or amount disputes under section 408.7057 go to the AHCA claim dispute program.
